Family Abduction Outside Of The Hague Convention

The biggest challenge of international custody is jurisdiction. Which country has governance over the custody matter in question? Fortunately, in 1980, the United States entered into an international treaty known as the Hague Convention (1980 Hague Convention on the Civil Aspects of International Child Abduction). This treaty provides a civil mechanism to resolve international child custody matters and ensure a child’s safe return to his or her country of habitual residence.

Due to Texas’ proximity to the southern U.S. border, we often work with clients whose former spouses have threatened to take their children to Latin American countries.
