Under Texas Family Code Sec. 162.001, an adult may petition to adopt a child in the state of Texas if both parents have terminated their parental rights or if one parent still has his or her parental rights and that person’s spouse is seeking adoption as a stepparent. Adoption Requirements

The Texas Department of Family and Protective Services (DFPS) has certain requirements for adoptive parents. A person may be single or married but must be at least 21 years old, mature and financially stable. The person must complete an application and share information about their background and lifestyle. He or she must also provide proof or marriage or divorce (if applicable), provide references and perform background/criminal checks on all adults living in the household. The prospective adoptive parent must also agree to a home study (which all household members must attend) and attend a training session on issues concerning neglected and abused children.

Being an adoptive parent is a huge responsibility. Parents must provide permanent homes for children and provide for their short-term and long-term needs into adulthood. This includes physical, mental, emotional, cultural, social and educational needs, which vary depending on the child’s age.

Adoptive parents can choose to become foster parents as well to care for children who are not yet ready to adopt. The prospective adoptive parents will be forced to undergo an evaluation to determine if they are fit parents and able to care for a child until adulthood.
