Texas Adoption Law
Under Texas Family Code Sec. 162.001, an adult may petition to adopt a child in the state of Texas if both parents have terminated their parental rights or if one parent still has his or her parental rights and that person’s spouse is seeking adoption as a stepparent. If a person seeking to adopt is married, both spouses must petition to adopt jointly. However, a person does not need to be married in order to adopt a child.

Adoption Requirements
The Texas Department of Family and Protective Services (DFPS) has certain requirements for adoptive parents. A person may be single or married but must be at least 21 years old, mature and financially stable. The person must complete an application and share information about their background and lifestyle. He or she must also provide proof or marriage or divorce (if applicable), provide references and perform background/criminal checks on all adults living in the household. The prospective adoptive parent must also agree to a home study (which all household members must attend) and attend a training session on issues concerning neglected and abused children.
