  • Cocaine

Section 481.115 of Texas Health and Safety Code states that if a person possesses less than 1 gram among the substance stated in the classification is considered a felony; 4-200 grams is a 2nd-degree felony; and anyone possessing more than 200 grams is a 1st degree felony.

  • Penalty Group 2

The following are the drug classifications:

  • Ecstasy or MDMA
  • Hashish
  • PCP
  • Other cannabinoids created from cannabis or marijuana

Section 481.116 of Texas Health and Safety Code indicates that having at least 1 and no more than 4 grams of these substances is a 3rd-degree felony. 4 to 400 grams is considered a 2nd degree felony. Possession of more than 400 grams of a controlled drug is a first-degree felony.

  • Penalty Group 3

The following are the drug classifications:

  • Anabolic steroids
  • Benzodiazepines
  • Methylphenidate or Ritalin
  • Valium
  • Xanax
  • Opioids not listed in Group 1

Section 481.117 states that possessing Xanax or other substances indicated under group 3 is a Class A misdemeanor. If 28 or less than 200 grams is considered a 3rd-degree felony. If 200 or less than 400 grams is considered a 2nd-degree felony; and possessing 400 grams or more is a 1st-degree felony.

  • Penalty Group 4 

According to Section 481.118, penalties under this group include opioids and opiates that were not included in the prior groupings. Penalties for possessing category 4 substances are the same as those for having group 3 substances.
